WithJia

Privacy Policy

9763341 Canada Inc. ("WithJia," "we," "us," or "our") operates WithJia, Jia, and withjia.com.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you interact with our services.

By using the Service, you acknowledge the practices described in this Privacy Policy.

1. Scope

This Privacy Policy applies to personal information processed in connection with:

  • the WithJia website;
  • Jia conversations;
  • text and voice interactions;
  • onboarding and account management;
  • memory and personalization features;
  • proactive check-ins and related communications;
  • subscriptions and payments;
  • customer support; and
  • other related WithJia services.

Services, applications, telecommunications networks, device providers, or platforms you independently use to access the Service may maintain their own privacy practices. Their practices are governed by their own terms and policies.

2. Information We Collect

Depending on how you use the Service, we may collect the following categories of information.

Account and Identifier Information

This may include name, preferred name, phone number, email address, account identifiers, authentication-related information, country, region, or timezone information, language and communication preferences, and account settings.

Conversation and Interaction Information

This may include messages you send to Jia, responses generated during conversations, conversation content, conversation context, topics discussed, feedback, instructions, and other information you voluntarily provide.

Voice and Audio Information

Jia calls are recorded and transcribed. We retain written transcripts and useful conversation details to provide continuity. A call may occasionally be reviewed to improve the quality of Jia's conversations. Recordings are automatically deleted after 14 days; this period applies to call recordings, not to transcripts, saved memories, or every other record.

Recording is part of the voice service and cannot be turned off during a call. Recordings and transcripts are kept private and are never sold or shared for anyone's profit.

Voice or audio information may be considered sensitive or biometric information under certain laws depending on how it is processed and the jurisdiction involved.

Where applicable law imposes specific requirements concerning voice, audio, biometric, or other sensitive information, we will handle that information in accordance with those requirements.

Memory and Personalization Information

To provide conversational continuity, we may process or retain information derived from interactions, such as preferences, relevant personal context, goals, interests, names or relationships you discuss, topics you want Jia to remember, recent conversation context, and personalization information.

Memory systems may make mistakes or retain information that becomes outdated.

You may contact us regarding correction or deletion requests as described below.

Subscription and Transaction Information

We may process information relating to subscription status, plan type, purchases, transaction identifiers, billing status, payment confirmations, refunds, discounts, credits, usage allowances, and related transaction records.

Payment credentials may be processed directly by payment-processing service providers. We do not necessarily receive or store complete payment-card credentials.

Communications and Consent Information

We may maintain records relating to consent to terms or policies, messaging preferences, opt-ins and opt-outs, communication history, check-in preferences, support communications, notices delivered to you, and other records reasonably necessary to demonstrate your communication choices.

Usage and Technical Information

We may automatically collect information such as device and browser information, network information, IP address, timestamps, session information, pages or features accessed, service usage, error information, diagnostic information, security events, and technical logs.

Sensitive Information

Because Jia is conversational, you may voluntarily discuss information that applicable law considers sensitive or highly personal.

You control what you choose to share.

You are not required to disclose sensitive personal information merely to have an ordinary conversation with Jia.

Please do not provide information about yourself or another person that you do not want processed as described in this Privacy Policy.

3. How We Collect Information

We may collect information:

  • directly from you;
  • from your interactions with Jia;
  • automatically when you use the Service;
  • when you create or manage an account;
  • when you purchase or manage a subscription;
  • when you contact support;
  • from systems used to deliver, maintain, or secure the Service; and
  • from service providers acting on our behalf.

4. How We Use Information

We may use personal information to:

  • provide and operate the Service;
  • understand and respond to your requests;
  • generate responses;
  • maintain conversational context;
  • provide memory and personalization;
  • authenticate users;
  • administer accounts and subscriptions;
  • meter and manage service usage;
  • process transactions;
  • provide customer support;
  • deliver requested or permitted communications;
  • provide reminders and check-ins;
  • maintain communication preferences and consent records;
  • detect fraud, abuse, security risks, and misuse;
  • troubleshoot errors;
  • maintain reliability and performance;
  • understand how the Service is used;
  • evaluate and improve conversational quality, including occasional review of a chat or call;
  • enforce our Terms of Service;
  • establish, exercise, or defend legal claims;
  • comply with legal, regulatory, accounting, tax, and contractual obligations; and
  • protect the rights, safety, security, and property of WithJia, users, and others.

Where applicable law requires a particular legal basis, we process information on one or more legally permitted bases, including consent, performance of a contract, legitimate interests, compliance with legal obligations, and other bases recognized by applicable law.

5. Artificial Intelligence and Automated Processing

Jia uses automated and artificial-intelligence technologies to process interactions and generate responses.

Conversation information is used to respond to you, remember useful context, and occasionally review conversational quality. Your conversations are not used to train AI models. Remembering your preferences or context is different from training a model, and there is no separate AI-training opt-out setting.

Automated systems also support the operation, security, and reliability of the Service as described in this Policy.

Automated systems may make mistakes, including incorrect inferences about information you provide.

The Service is not intended to make legal, financial, employment, insurance, credit, eligibility, or other similarly significant decisions about you.

Automated systems may affect how Jia responds to certain content, including content that may raise safety or misuse concerns.

We do not make private conversation content publicly available merely because it is processed by automated systems.

6. Memory and Personalization

Jia may retain information from or derived from your interactions where reasonably necessary to provide continuity and personalization.

Stored information may include preferences, context, topics, goals, people or events you discuss, communication preferences, and other details relevant to future conversations.

Memory does not necessarily represent a complete record of your conversations and may contain inaccuracies.

Memory is part of how Jia works and cannot be turned off while you continue chatting. There is no off-the-record mode with nothing saved.

Conversation data, transcripts, and other records may be stored separately from memory. Removing a remembered item or deleting your WhatsApp chat does not automatically erase related copies held by Jia. For correction, deletion, or a fresh start, contact support@withjia.com. Eligible information is deleted within 30 days of the request, subject to the retention exception described under Deletion Requests.

7. Service Providers

We engage service providers and subprocessors to perform functions necessary to operate and support the Service.

These functions may include:

  • cloud infrastructure and hosting;
  • communications;
  • artificial-intelligence and data processing;
  • voice and transcription processing;
  • data storage;
  • security;
  • authentication;
  • analytics and diagnostics;
  • customer support;
  • payment processing; and
  • other operational services.

These providers may process information on our behalf subject to applicable contractual, technical, organizational, and legal restrictions.

We seek to limit access to information to what is reasonably necessary for the provider's function.

Service providers may process information in countries other than the country where you live.

We may change service providers as the Service evolves.

8. When We Disclose Information

We may disclose personal information in the following circumstances.

Service Providers

We may provide information to service providers performing functions on our behalf as described in this Privacy Policy.

Legal Reasons

We may disclose information where we reasonably believe disclosure is required or permitted by applicable law, legal process, court order, regulatory request, governmental request, or other lawful authority.

Protection of Rights, Security, and Safety

We may disclose information where reasonably necessary to investigate fraud or abuse, enforce our agreements, protect the security or integrity of the Service, protect WithJia, users, or third parties, establish or defend legal claims, or respond to a situation where disclosure is permitted by applicable law.

Nothing in this Privacy Policy should be interpreted as a promise that we continuously monitor conversations or will detect or intervene in emergencies.

Business Transactions

If WithJia is sold or transferred to a new owner, information may transfer with the Service so Jia can continue operating. The information must continue to receive the same protection. We will tell you before the transfer so you can request deletion at support@withjia.com if you prefer.

At Your Direction

We may disclose information when you direct, request, or consent to the disclosure.

9. Sale and Targeted Advertising

We do not sell personal information for monetary consideration.

Private conversations are never sold, shared with advertisers, or used for advertising, including targeted third-party advertising. We do not turn private conversations into a source of profit; paid conversation access is how WithJia earns revenue.

These commitments do not prevent the service-provider processing described in this Policy.

If our practices change in a way that creates additional rights under applicable privacy law, we will provide disclosures and choices required by that law.

10. Payment Information

Transactions may be processed by payment-processing service providers.

We may receive transaction-related information necessary to manage subscriptions, confirm payments, provide credits, address billing issues, process refunds, maintain accounting records, and prevent fraud.

We do not need access to complete payment-card information to perform many of these functions.

Payment providers maintain their own security and legal obligations regarding information they directly process.

11. Communications

We may communicate with you regarding your account, security, authentication, purchases and billing, subscription status, customer support, changes to the Service, legal notices, conversational continuity, requested reminders, check-ins, and other communications permitted by your preferences and applicable law.

Where consent is required for a particular type of communication, we will seek the applicable consent.

Commercial or promotional electronic messages are sent in accordance with applicable messaging and anti-spam laws.

Where legally required, such messages will include an appropriate method to unsubscribe or opt out.

You may withdraw consent or change communication preferences where permitted by law.

You can turn off proactive check-ins through your preferences or tell Jia you would rather not receive them. If you need help, contact support@withjia.com. Stopping check-ins does not stop Jia from replying when you message, or prevent important account updates, such as a low message-pack balance, and other necessary account, transaction, security, or legal communications.

A check-in is a conversational follow-up, not real-time monitoring of your wellbeing or safety. Jia will not contact someone because you do not reply.

12. SMS Privacy

If you separately opt in to SMS communications, we may maintain your mobile number, consent record, opt-in source, messaging preferences, and related messaging history.

Mobile information, including mobile phone numbers and SMS consent information, is not sold, rented, or provided to third parties for their independent marketing or promotional purposes.

Information may nevertheless be processed by service providers where necessary to deliver communications or operate the Service.

13. Data Retention

Call recordings are automatically deleted after 14 days. This period is specific to call recordings; it does not apply to every transcript, memory, log, or account record.

Useful conversational memories are kept to provide continuity and personalization. Conversation data and other records may be retained separately for their respective purposes, including operating accounts, security, transactions, and compliance with applicable obligations.

You can request deletion of eligible information, including memories and recordings, at support@withjia.com. The 30-day deletion commitment and its retention exception are described below.

We may retain de-identified or aggregated information where permitted by law.

14. Security

We use administrative, technical, and organizational safeguards designed to protect personal information. Information is encrypted in transit and at rest, stored with trusted providers, and subject to strictly limited access. Your chats are not public or visible to other Jia users.

WhatsApp encrypts messages in transit to Jia, but Jia and its service providers must process them to respond and provide memory. This is not an end-to-end guarantee that only you can access information across every system used by the Service.

No website, communication channel, database, artificial-intelligence system, network, transmission method, or storage system can be guaranteed to be completely secure.

Accordingly, we cannot guarantee that unauthorized access, loss, misuse, alteration, disclosure, or another security incident will never occur.

If a security incident affecting personal information occurs, we will take steps appropriate to the circumstances and comply with applicable notification requirements.

15. Your Choices and Privacy Rights

Depending on where you live and applicable law, you may have rights concerning your personal information.

These may include rights to request access to personal information, obtain information about how it is processed, request correction of inaccurate information, request deletion, withdraw consent where processing is based on consent, object to or restrict certain processing, receive certain information in a portable format, opt out of certain communications, make a complaint to an applicable privacy regulator, and exercise other rights provided by applicable law.

Not every right applies in every jurisdiction or circumstance.

The retention exception for deletion requests is explained below. These additional legal rights do not limit our stated 30-day commitments for eligible-data deletion and data-copy requests.

To exercise a privacy right, contact support@withjia.com.

We may take reasonable steps to verify your identity and authority before fulfilling a request.

You can request a copy of your information at support@withjia.com and will receive it within 30 days. We also comply with any shorter timeframe required by applicable law.

16. Deletion Requests

Request correction or deletion by contacting support@withjia.com. A message to Jia does not itself delete your information or confirm that a deletion request has been completed.

We begin removing eligible information when you request deletion and complete deletion from our systems, including backups, within 30 days. This includes eligible memories, recordings, and other old data covered by your request. Information awaiting deletion is not used or shared in the meantime.

Some information may remain temporarily in backups during that process, or where retention is required or permitted. The 30-day commitment applies to eligible data, subject to this retention exception. Contact support@withjia.com for the status of your request.

17. Information About Other People

You may choose to discuss other people during conversations with Jia.

If you provide personal information about another person, you are responsible for ensuring that you have an appropriate right or lawful basis to provide that information.

Do not use Jia to unlawfully disclose confidential, restricted, or private information about another person.

18. Children

The Service is intended for people 18 years of age or older.

We do not knowingly collect personal information from anyone under 18 for use of the Service.

If we learn that an individual under 18 has provided personal information through use of the Service, we may take reasonable steps to restrict access, terminate the account where appropriate, and delete or otherwise handle the information as required by applicable law.

Parents or guardians who believe a minor has provided personal information to us may contact support@withjia.com.

19. International Processing

WithJia operates across multiple jurisdictions.

Personal information, including conversation, voice, memory, account, and technical information, may be processed or stored in a country other than the country in which you live.

Data-protection laws in another jurisdiction may differ from those in your jurisdiction.

Where applicable law requires safeguards for international transfers of personal information, we will use legally recognized safeguards appropriate to the circumstances.

20. Regional Privacy Rights

Residents of certain jurisdictions may have additional privacy rights under local law.

Where applicable privacy law provides rights or disclosures beyond those described in this Policy, those rights and requirements apply.

Nothing in this Policy is intended to restrict a privacy right that cannot lawfully be waived.

We may provide additional jurisdiction-specific notices where required by applicable law.

21. Cookies and Similar Technologies

When you visit withjia.com, we or service providers acting on our behalf may use cookies, local storage, and similar technologies where necessary to operate, secure, maintain, or understand use of the website.

These technologies may be used for purposes such as authentication, session management, security, remembering preferences, website functionality, diagnostics, and understanding general website usage.

We do not use cookies to serve targeted third-party advertising.

Your browser may allow you to block, limit, or delete cookies and similar technologies.

Blocking certain technologies may prevent some website or account features from working correctly.

Where applicable law requires consent or additional controls for non-essential cookies or similar technologies, we will provide the required choices.

Conversation content, memory information, and account information described elsewhere in this Policy are not collected solely through website cookies.

22. Changes to This Privacy Policy

Effective and last revised: October 12, 2026.

We may update this Privacy Policy as the Service changes, our practices change, or applicable laws change.

Where required by law, we will provide additional notice or obtain consent before a material change becomes effective.

We may maintain historical versions, publication records, effective dates, and acceptance records internally for compliance, security, legal, and recordkeeping purposes.
